Yes. In Scotland, unlike in England and Wales, a solicitor must handle the conveyancing process by law. Licensed conveyancers cannot act in Scotland. Your solicitor submits your offer, concludes missives and registers the title on your behalf. It is not something you can do yourself.

Once your offer is accepted, your solicitor will carry out property searches, review the title deeds, check the Home Report, liaise with your mortgage lender and negotiate the conclusion of missives. Once missives are concluded the sale is legally binding. Your solicitor then manages the settlement process through to your entry date.

A Home Report is a legal requirement for any property being marketed for sale in Scotland. As a buyer, you are entitled to request a copy before making an offer. It includes a single survey, an energy performance certificate and a property questionnaire. Your solicitor will review the Home Report as part of the conveyancing process and advise you on any issues it raises.

Our target exchange time is 12 to 14 weeks, which is around four weeks faster than the industry average. Timescales can vary depending on whether a mortgage is involved, the complexity of the title and how quickly the other parties respond. Your dedicated solicitor keeps you updated throughout so you always know where your case stands.

Missives are the formal written offers and acceptances exchanged between your solicitor and the seller’s solicitor. Once all the terms are agreed and missives are concluded, the sale becomes legally binding for both parties. This is different from England and Wales where a sale only becomes binding at exchange of contracts.

We handle the conveyancing side of your purchase. For mortgage advice, we recommend speaking to an independent mortgage broker who can compare products across the whole market. Once you have a mortgage offer in place, your dedicated solicitor will liaise directly with your lender throughout the conveyancing process.

Land and Buildings Transaction Tax (LBTT) is the Scottish equivalent of Stamp Duty. First-time buyers in Scotland benefit from LBTT relief on properties up to a certain threshold. Your solicitor will calculate your LBTT liability, advise you on any relief you are entitled to and submit the LBTT return to Revenue Scotland on your behalf at completion.
