The key to a successful simultaneous transaction is careful coordination of both sets of missives so that your entry dates align as closely as possible. Having one solicitor managing both transactions, as we do at Kee Property, significantly reduces the risk of delays or misaligned timelines.

Once missives are concluded on your purchase, you are legally committed to completing it. If your sale then falls through before missives are concluded on the sale side, you may need to proceed with your purchase using bridging finance or other arrangements. This is why your solicitor will carefully manage the timing of concluding missives on both transactions to minimise this risk. We will always advise you clearly on the risks at each stage.

This depends on your financial position. If you are able to complete your purchase independently of your sale proceeds, for example if you have sufficient savings or access to bridging finance, then it is possible to conclude missives on your purchase before your sale is finalised. If your purchase is dependent on your sale proceeds, your solicitor will usually recommend concluding missives on both transactions as close together as possible.

A bridging loan is a short-term finance product that covers the gap between completing your purchase and receiving the proceeds of your sale. It is typically used when entry dates cannot be perfectly aligned or when a buyer needs to complete a purchase before their sale has settled. Bridging finance can be expensive and your solicitor will advise you on whether it is necessary in your circumstances and how to minimise the period for which it is required.

Your solicitor negotiates the entry dates on both your sale and your purchase as part of the missives process. The goal is to align them so that you receive the proceeds of your sale in time to fund your purchase, ideally on the same day. Where a perfect alignment is not possible, your solicitor will advise you on the options available to bridge any gap, including temporary storage arrangements and short-term accommodation if needed.

Once missives are concluded on your purchase, the seller is legally committed and cannot withdraw without facing legal consequences. Before missives are concluded, however, either party can withdraw without obligation. Your solicitor will work to conclude missives on your purchase as quickly as possible to give you the legal certainty you need, while managing the timing carefully in relation to your sale.
