Yes. In Scotland, a solicitor must handle the conveyancing process for both buyers and sellers by law. Your solicitor prepares and concludes the missives, carries out title checks, prepares the disposition and manages the settlement with the buyer’s solicitor. It is not possible to handle this yourself or through a licensed conveyancer in Scotland.

A disposition is the legal document that transfers ownership of your property from you to the buyer. Your solicitor drafts this document, which is then signed by you and delivered to the buyer’s solicitor at settlement. The buyer’s solicitor registers the disposition with the Registers of Scotland, formally completing the transfer of ownership. Without a valid disposition, the sale cannot legally complete.

If you have an outstanding mortgage on the property, your solicitor will arrange for it to be redeemed at settlement using the proceeds of the sale. This involves obtaining a redemption figure from your lender, deducting the amount owed from the sale price and paying the balance to you after all fees and costs have been deducted. Your solicitor manages this entire process on your behalf.

A property sale becomes legally binding once missives are concluded, meaning all the terms of the offer and acceptance have been agreed in writing between the solicitors. At this point neither party can withdraw without legal consequences. This provides sellers in Scotland with significantly more certainty than in England and Wales, where sales can fall through up until exchange of contracts.

The items included in a property sale are agreed as part of the missives. In Scotland, fixtures and fittings are generally assumed to be included unless specifically excluded. Moveables such as furniture and appliances can be included or excluded by agreement. Your solicitor will advise you on what to include in the missives and ensure the terms accurately reflect what has been agreed with the buyer.

Timescales can vary depending on the complexity of the title, whether the buyer has a mortgage and how quickly the other parties respond. Your solicitor will review the title deeds to confirm you have the legal right to sell the property, check for any outstanding charges or burdens on the title, prepare the documentation required for settlement and liaise with your mortgage lender to arrange redemption if required.
